Winter Storm Fern wreaked unprecedented havoc over the weekend, leaving 830,000 people without power, cancelling 19,000 flights, and, tragically, taking the lives of 28 people.

Truckers were no exception. As roads closed, interstates froze, and the supply chain stalled, many carriers struggled to deliver emergency supplies to the affected areas.

To aid in alleviating these challenges, the FMCSA issued an order across 40 states suspending hours-of-service regulations, promoting the successful delivery of essential supplies. The order will remain in force until February 6, 2026.

Who Qualifies for the FMCSA Winter Storm Waiver?

 

The exemption applies exclusively to carriers hauling goods directly related to emergency relief efforts.

These goods can include the following:

  • Heating fuel, including propane, natural gas, and heating oil
  • Food
  • Medical supplies
  • Generators
  • Water
  • Sewer services

Regardless of the trip’s origin, the exemption will be applicable if the load is intended for emergency relief services.

 

Who Doesn’t Apply for the FMCSA Winter Storm Waiver?

 

The order makes clear: Routine commercial deliveries cannot claim the exemption. Additionally, even mixed loads of emergency supplies will not receive a waiver.

Only loads devoted to emergency relief efforts will be permitted the exemption. Even if a carrier has a partial load of water bottles bound for the affected area, the load must be entirely consigned for emergency use.

 

Resuming Regular Work

 

The order also outlines a clear path back to regular work duties.

When the period of emergency assistance ends, you must take a 10-hour break following an involvement of 14 or more hours. For drivers with passengers, an 8-hour break must be taken after 10 hours.

If these requirements are not obeyed, the typical penalties for violating work hours will ensue.

 

The FMCSA winter storm waiver is intended to bring flexibility to truckers aiding in emergency relief efforts. Though the issue is helpful, it is strict in who it serves.
