What is the AEB Mandate?

Automatic Emergency Brakes, or AEBs, are powerful devices that use sensors to trigger braking if a collision appears imminent.

The AEB mandate requires all trucks over 10,000 pounds to be manufactured with automatic emergency braking. To be clear, the mandate does not require carriers to install AEB systems retroactively; only manufacturers of new models must comply.

Though the mandate to require AEBs on heavy trucks is a step toward increased safety, its widespread implementation is one the industry must brace for.

So, when is the mandate scheduled to take place?

 

When is the AEB Mandate Going into Effect?

The short answer: No one knows.

Many carriers have been under the impression that the mandate begins on September 1, 2029, but that portion applies only to passenger cars and lightweight trucks.

In reality, the AEB mandate timeline has been all over the place:

 

November 2021

Congress directed the Department of Transportation to develop AEB requirements for heavy commercial vehicles.

 

July 6, 2023

NHTSA and FMCSA published the joint heavy-vehicle AEB proposal.

 

September 5, 2023

The original public comment period closed.

 

2025

A final rule had been expected, but the agencies did not publish one. NHTSA said additional research had delayed the process.

 

March 2026

FMCSA said the agencies planned to issue a supplemental proposed rule, but listed the timing as “to be determined.”

The rule remained in the proposed stage, with a supplemental proposal targeted for July 2026.

 

September 2, 2026

No final heavy-vehicle AEB rule or fixed compliance date had been published.
